What is lead violation management?

It is the process of taking a lead paint order issued against a rental property and resolving it before the deadline. That means reading the citation, scoping every cited component, performing the correction using lead-safe practices, and assembling the documentation the health department needs to close the file.

Most of Buffalo and Niagara Falls housing predates 1978, so most of it has lead paint somewhere. Owners do not usually get into trouble for having it. From notice to clearance

1. Read the order properly

Which components are cited, what standard applies, what the deadline actually is, and whether an extension is realistic. Most owners misread at least one of these.

2. Scope and price the correction

Component by component, in writing. You see the number before anything begins, and you know which items are mandatory and which are advisable.

3. Do the work lead safe

Containment, correct removal or stabilisation methods, HEPA cleaning and proper waste handling. Performed by the same company that scoped it, through our general contracting side.

4. Documentation and clearance

Photographs, records and clearance paperwork assembled and submitted so the file closes rather than reopening in six months.

5. Keep it from recurring

If the property stays under our management, the conditions that generated the order get inspected for, so the next tenant does not generate the next notice.

Lead violation questions

I got a lead violation on my Buffalo rental. What do I do first?

Will I be fined for a lead paint violation?

Penalties are tied to missing the deadline or failing to correct the condition, not to the violation existing. Owners who move quickly and document the work properly generally resolve it. Owners who ignore the notice or use an uncertified contractor make it considerably worse.

How long does clearing a lead violation take?

It depends on how many components are cited and whether the unit is occupied. A small number of window and trim components can move quickly. A whole-unit order takes longer. The controlling factor is usually how fast the work starts, not how long it takes to do.

Can any contractor do lead work?

No. Work disturbing lead paint in pre-1978 housing must be performed using lead-safe practices by an appropriately certified firm, and the documentation matters as much as the work. Using an uncertified contractor can leave the violation unresolved and the owner exposed.
